Email Policy of MIS Sciences Corporation

The following is the email policy of MIS Sciences Corporation (MIS) for all accounts that have their email hosted on any server owned or operated by MIS.

POP3 Support
POP3 is fully supported for all mail clients that support POP3. MIS will only provide support for the recent version of the mail client and one previous version. Any older versions are not supported and the customer must contact the vendor for support.

IMAP Support
MIS conditionally supports the IMAP4 protocol. IMAP4 has been tested using Microsoft mail clients without any problems. Incapability with Macintosh is a known issue and can not be resolved. IMAP4 is not recommended since mail is left on the server and the 10 MB mailbox limit will be reached quickly. MIS does not provide any support for the IMAP4 protocol. Support must be obtained from the vendor for all IMAP issues.

Mail Retention 45 days
Mail is retained on the server for this period. Any message older that 45 days is automatically deleted and cannot be recovered.

Mailbox Size (POP3) - 50 MB
This is the maximum allowable mailbox size. This means that once you have reached this size in stored messages, ALL new mail will be rejected until messaged are deleted to reduce the size of the stored messages. A warning message is provided when the mailbox reaches 49 MB. Optionally, 150 MB mailbox sizes are available at an additional charge.

Mailbox Size (Web Mail) - 50 MB
This is the maximum allowable web mail mailbox size. This means that once you have reached this size in stored messages, ALL new mail will be rejected until messaged are deleted to reduce the size of the stored messages. No warning message are provided.

Maximum Message Size (POP3) - 4 MB
This is the maximum message size, including attachments. This means that you can not send or receive any message greater than the maximum message size. If you use a program to compress or Zip your file, this should be ample. Many users are still on a dial-up connection and large files can take several hours to download.

Maximum Message Size (Web Mail) - 2 MB
This is the maximum message size, including attachments (1 MB Maxium). This means that you can not send any message greater than the maximum message size. If you use a program to compress or Zip your file, this should be ample.

Maximum Number of Recipients - 20
This is the maximum number of recipients that you can have as a total on all address lines (TO, CC, BCC). This is to prevent the mail server as being used as a bulk mail program or list server. If you have a list larger than the maximum, a mail list may be more appropriate for your needs.

Invalid Recipients - 2
This is the total number of invalid recipients in the TO: CC: and BCC: fields. This is considered SPAM and the IP will be blocked from sending mail through the MIS mail servers. See 'Definition of SPAM' below.

Maximum Number of BCC Recipients - 4
The use of BCC is a common practice of SPAMMERS and our policy is to block any email with more than four BCC addresses. This value can not be changed. If you need to mail to a large number of recipients, a mail list may suit your needs.

Email Backup and Recovery
MIS performs scheduled backups of the mail server. This allows for a recovery of the complete email server, including all mailboxes and messages at the time of any system failure. Individual domains or mailboxes can not be restored from the backup. It is incumbent on individuals to ensure their personal computer is backed up to protect any email they receive.

Mail Archive
MIS does not archive inbound or outbound email messages. MIS can not recover any lost or deleted messages. MIS will comply with any legal process that requires MIS to archive email messages for one or more accounts.

Virus Checking
If you subscribe to Virus Checking, we attempt to check all incoming email for viruses. Our virus definitions are updated every 60 minutes, 24 hours a day. MIS DOES NOT warrant that any or all viruses will be detected and/or eliminated. It is the responsibility of the email user to have a virus detection program on their computer to ensure that they are protected from any potential virus. This will provide you with the most up to date virus protection available.

ANTI-SPAM Filtering
We can optionally filter incoming email for unsolicited email (SPAM). This is a optional service and you MUST request that ANTI-SPAM filtering be added to your domain/account. See our ANTI-SPAM page for more information. MIS DOES NOT warrant that any or all SPAM will be detected and/or eliminated.

Unsolicited Email (SPAM)
MIS has a zero-tolerance policy concerning the sending of unsolicited email (SPAM). The sending of unsolicited email is considered a violation of the MIS Terms and Conditions will result in the immediate suspension and termination of all services, including email. The termination of services is considered "with cause" and legally justified and client waives any and all rights they may have under any statue in any jurisdiction for any and all action against MIS for any past, present, or future damages that may result from the account suspension and termination.

Definition of Unsolicited Email (SPAM)
For the purpose of this policy, unsolicited email (SPAM) is defined as any email sent from or through any MIS controlled server to any recipient that the sender does not have an existing business or personal relationship with and without the express permission of the recipient to receive such email. Sending email with any of the following is also considered unsolicited email (SPAM):
1 - email with an invalid FROM address
2 - email with a FROM address that does not properly identify the sender
3 - email with more that 20 recipients (total of TO, CC, and BCC recipients)
4 - email with more than four BCC recipients
5 - email with more than two invalid recipient addresses (TO, CC, BCC)
6 - email that is not in compliance with or violates any portion of Section 17538.4 et.al. of the California Business and Professions Code.

Account Suspension and Termination
Any violation of the MIS unsolicited email (SPAM) policy will result in immediate termination, without notice, of all all accounts with MIS. Any account suspension or termination is deemed "with cause" and legally justified and client waives any and all rights they may have under any statue in any jurisdiction for any and all action against MIS for any past, present, or future damages that may result from the account suspension and termination. All active accounts will be suspended or terminated, including all email, and access to all servers will be disabled. MIS reserves the right to recover damages as specified in Section 17538.45(f)(1) of the California Business and Professions Code.

Account Reinstatement
A $200.00 reinstatement fee applies to all suspended or terminated accounts. Any account suspended or terminated may be reinstated at the sole discretion of MIS. Reinstatement of a terminated or suspended account, as the result of violation of the MIS unsolicited email (SPAM) policy, requires the payment of all expenses or damages incurred by MIS resulting from the violation of the policy.

Notice
All notices and other communications which are required or may be given by MIS to customer under this policy shall be provided to customer by email to the last known email address provided to MIS by customer. Customer acknowledges and accepts email notification as the sole and proper method for notification.

Governing Law
The validity, performance and enforcement of this policy shall be governed by the laws of the State of California. It is hereby agreed that the exclusive jurisdiction and venue shall be in the Federal or State courts located in the County of Los Angeles, California, with respect to any claim or dispute between MIS and customer arising out of this policy.
